These terms cover your use of Lomita Labs WeatherNode and gateway hardware ("Devices"), the Lomita Labs website, dashboard, and APIs (together, the "Service"). By creating an account, claiming a Device, or using the Service you agree to these terms.
You need an account to see your Devices' data in the dashboard. Keep your credentials to yourself; you are responsible for activity under your account. You must be at least 18 to create an account.
Each Device carries a serial number and claim code on its label. Claiming links the Device to your account so its readings appear in your dashboard. Powered Devices report telemetry to Lomita Labs whether or not they have been claimed — claiming controls visibility in your account, not whether the Device reports. If you sell or transfer a Device, contact us so we can release the claim.
Plain-English summary: you always have access to your Devices' readings. Lomita Labs also retains the environmental telemetry our devices report and may aggregate, analyze, license, and sell environmental data and data products derived from it. Environmental data sold or licensed to third parties is not linked to your name, email, or exact account identity.
Frost, offline, and other alerts are best-effort conveniences. Radios drop, networks fail, sensors drift, and email can be delayed. Do not rely on the Service as your only protection for crops, property, or anything else of value. You are responsible for your own frost protection decisions.
Don't attempt to break, overload, reverse the security of, or extract other customers' data from the Service; don't use it for anything unlawful; don't resell Service access without a written agreement with us.
Devices are sold with the warranty terms stated at purchase. Firmware may update over the air to fix bugs, improve accuracy, or add features; some updates are required for continued Service compatibility.
The Service is provided "as is" without warranties of any kind, express or implied, including fitness for a particular purpose. To the maximum extent permitted by law, Lomita Labs' total liability for any claim related to the Service or Devices is limited to the amount you paid us for the Device or Service giving rise to the claim in the 12 months before the claim arose. Lomita Labs is not liable for crop loss, frost damage, or other consequential damages.
We may update these terms; material changes will be posted here with a new effective date, and continued use after that constitutes acceptance. You can close your account at any time. We may suspend accounts that violate these terms.
